 Your employer can terminate you after you suffer and report a work related injury, but the employer still must pay you workers’ compensation benefits. Unfortunately, unless you are a member of a union with a collective bargaining agreement or you have a specific employment contract, we are all considered employees at will in Pennsylvania. So your employer can fire you if you report a work injury if you are injured and disabled and unable to do the job. However, the employer and its workers’ compensation insurance company must pay you workers’ compensation benefits if you are injured and disabled.
