Lowenthal & Abrams Represents Family of a Man Who Died Due to Head Injuries Suffered Outside a Lewisburg Tavern

 

Kenneth Beaver was at the Bull Run Tavern in Lewisburg having a night out with a friend. Beaver’s friend, Rickie Spencer said that Beaver consumed quite a bit of alcohol, including 8 beers and three shots of Jameson Green Tea. After leaving the Bull Run Tavern, Beaver wasn’t allowed to return due to his state of intoxication, so he went across the street to the Towne Tavern. He was followed by the bouncers from Bull Run. It is alleged that after Kenny entered Towne Tavern that the Towne Tavern Bouncer and the Bull Run bouncers engaged in actions causing Beaver to fall and sustain fatal head wounds.

In response to Beaver’s death, Dennis Abrams, attorney with Lowenthal & Abrams, filed a lawsuit against both Bull Run Tavern and Towne Tavern in Lewisburg.

Violently and Recklessly Caused Beaver’s Injuries and Death

Abrams’ lawsuit on behalf of the Beaver family alleges that the bouncers should have escorted Kenneth Beaver properly outside the bar instead of engaging in violent and reckless conduct. Further, the lawsuit alleges that it was clear that Beaver was intoxicated and at no time did any Bull Run employee seek to stop serving Mr. Beaver. Bars are responsible for not serving overly intoxicated people.

Destruction of Evidence

In addition to alleging that the employees for both bars failed to engage in proper conduct, Abrams also alleges that Bull run, “intentionally recklessly or negligently withheld or destroyed video surveil[lance] evidence.”

No Criminal Charges

A criminal investigation took place by Buffalo Valley Regional Police and the local district attorney determined that no charges would be filed. The reason for the lack of charges is that there was no evidence of, “criminal intent or recklessness.” However, the lack of criminal charges does not mean that the defendants engaged in appropriate conduct for purposes of a civl suit. It will be Abrams responsibility to prove that the employees were negligent and caused harm to Kenneth Beaver. Abrams told the Daily Item that the employees of both taverns, “should have treated Beaver with more care considering his obvious impaired condition.” He also noted that, “the tavern owners should provide better staff training to handle intoxicated customers.”

Why a Lawsuit?

Lowenthal & Abrams alleges that it was the conduct of these Lewisburg taverns which caused the death of Kenneth Beaver. It is our goal to obtain justice for his family.
