Why are More Doctors Being Sued in Lancaster?
Lawsuits against medical professionals and hospitals are decreasing across Pennsylvania due to tort reform, but claims in Lancaster are increasing. What is the reason for this surprising trend?
In 2012, Lancaster saw a six year high in negligence lawsuits against doctors and hospitals. 35 cases were filed in 2012, an increase of 9 from 2011. 2013 has already seen 20 cases filed. If these kind of numbers continue, Lancaster will have an all time high of negligence suits.
Personally, I have noticed an increase in contacts from residents of Lancaster when it comes to malpractice. Lowenthal & Abrams seems to be handling more cases out that way. Does this mean Lancaster doctors and hospitals are committing more malpractice? Does it mean people are more willing to sue than before? It is hard to tell.
What is Going on in Lancaster?
It is hard to say exactly. It could be that the expansion in the size of hospitals in Lancaster means procedures that might have originally been performed in another city are now being performed in Lancaster. An increase in risky procedures can mean an increase in errors, just through the law of averages. It also could be that the individuals who are moving into or already living in Lancaster are simply more willing to file complaints when they are injured. I have seen arguments that the increase is due to the fact that cases must be file in the county in which the injury occurred, but that change happened back in the early 2000s, so it does not explain the increase in 2012.
No matter the reason, make certain you do all you can to decrease your chances of being injured when you go to the hospital. Choose the best doctors and hospitals you can, and take charge of your health care.
