If your employer fires you, you can still collect workers’ compensation benefits. As long as you were injured on the job while doing your job, you can continue to collect workers’ compensation benefits, regardless of whether you are still an employee of your employer. Of course, if you are fired for willful misconduct, like blatantly violating the rules or committing some serious act of misconduct, then that could affect your right to receive workers’ compensation benefits. But if you are fired because of downsizing, or the poor economy, or because you simply are not able to do the job any more due to your work related injury and restrictions, than you are entitled to keep receiving workers’ compensation benefits.

*Certified as a Specialist in the Practice of Workers’ Compensation Law by the Pennsylvania Bar Association’s Section on Workers’ Compensation Law as Authorized by the Pennsylvania Supreme Court.
