Your Employer is Harassing You About Workers’ Compensation?

What to Do if Your Employer is Harassing You about Your Pennsylvania Workers’ Compensation Claim

Employer Harassing You About Workers' CompensationWe frequently get calls from worried people who tell us that they are afraid their employer is going to fire them, or that their employer is harassing them about their workers’ compensation claim. The employer sometimes is upset that the employee is on light duty instead of his original job, or that the employee wants the employer to report the injury in the first place. Sometimes the harassment can get downright dirty with the employer trying to get the employee to quit.

How to Respond to Harassment

First, never quit your job. If you quit your job, you are going to hurt your case and probably destroy it. If your employer is trying to get you to quit or making your life miserable, contact us at Lowenthal & Abrams so we can help you deal with the problem.

Your Employer Won’t File a Claim

If your employer refuses to file a claim, again, please contact us. If you are injured at work, your employer must file a claim. With very few exceptions, Pennsylvania employers are required to have workers’ compensation insurance, If your employer doesn’t have insurance, we can seek benefits from the Uninsured Employers Guaranty Fund (UEGF.)

Your Employer Fired You

Unless you have a contract, your employer can fire you while you are receiving workers’ compensation benefits. If you are fired, you do not lose your right to your workers’ compensation benefits. In fact, if you were on light duty and you get fired, unless you got fired because of your own bad behavior (i.e. for cause,) you can return to full benefits. If you get fired, give our certified expert* in Pennsylvania workers’ compensation a call. He will fight to restore your benefits.

Don’t Let Your Employer Bully You

If you are injured at work, you are entitled to workers’ compensation benefits. Don’t let an unethical employer bully you into not filing a claim or stopping your benefits. Call us today for help.
