Fracking Lawsuit Leads to $3 Million Verdict

As everyone in Pennsylvania knows, the safety of fracking is up to debate. People question whether fracking is safe, not only for the land, but for the health and well-being of the people who live nearby.
In Texas, the first fracking lawsuit involving health and property damage has resulted in a verdict of almost $3 million.
In the case, the jury found that the defendant, Aruba Petroleum, “intentionally created a private nuisance.” The amount of money was divided as follows:
- $275,000 for the loss of property value
- $2 million for past physical pain and suffering for the 3 members of the family
- $400,000 for past mental anguish
- $250,000 for future physical pain and suffering.
Pennsylvania Law Still Developing
Here in Pennsylvania, the laws and issues surrounding fracking are still developing. No doubt we will see lawsuits come to fruition here in the near future. The questions will surround permanent damage to land value, permanent damage to health, and how that damage will impact people in the future.
