The patient was a healthy engineer. In the weeks following his orthopedic surgery, he developed shortness of breath—a known and serious warning sign of a pulmonary embolism. The family doctor evaluated his symptoms but failed to recognize or rule out the presence of a pulmonary embolism. This is a serious condition that occurs when a blood clot, originating in a deep vein in the leg, travels through the bloodstream and blocks an artery in the lungs. This warning sign was evident in the fact that he had an immobilized limb post-surgery.
Any patient in this man’s condition should be immediately evaluated for this complication. The doctor failed to meet the standard of care and thus missed an opportunity to diagnose and provide life-saving treatment. The man died just six days after surgery.
During a seven-day trial, Attorneys Dennis Abrams and Ed Grant of Lowenthal & Abrams presented claims and evidence of medical malpractice and negligence against the family doctor. A family medicine expert testified that the symptoms the man had were textbook indicators of a pulmonary embolism and that any physician should have been able to recognize and act on them.
