Can I Collect Pain and Suffering as Part of my Workers’ Compensation Claim?
You cannot collect money for pain and suffering in workers’ compensation cases. There is no pain and suffering in workers’ compensation cases. Workers’ compensation was invented because they did not want people to file lawsuits against their employers. Workers’ compensation is a wage loss system and a medical system. So you get a percentage of your wages, usually but not always two thirds of your gross wage, and your medical benefits for your work injury. But you cannot collect for pain and suffering even though you have undergone a great deal of pain and suffering.
